A _ The Pulse Reward Programme general terms and conditions
1. The Pulse Reward Programme
1.1 These are the general terms and conditions, which apply to your membership of the Pulse Reward Programme ("the Programme") and the award of Pulsebeats ("Pulsebeats").
1.2 Any further specific terms and conditions of the scheme under which you are registered to receive Pulsebeats ("Individual Reward Scheme") will be as notified on your registration for the Individual Reward Scheme. The specific terms and conditions for the Individual Reward Scheme for SonyCard holders are set out in Section B below.
1.3 Your membership of the Programme starts when you are notified in writing by Sony United Kingdom Ltd ("SUKL") that your registration has been accepted and ends when your membership is closed either by yourself in writing, or by SUKL or according to the specific terms and conditions of the Individual Reward Scheme.
1.4 Your membership of the Programme is a matter for SUKL who are solely responsible for the Programme's operation and fulfilment. The Programme is made available by SUKL completely at its discretion.
2. How to Earn Pulsebeats
2.1 You will earn Pulsebeats according to the terms and conditions of your Individual Reward Scheme as notified on your registration for the Individual Reward Scheme.
2.2 A maximum number of 99,999 Pulsebeats can be earned in any month and a maximum of 250,000 Pulsebeats can be earned in any year, unless otherwise notified.
2.3 Pulsebeats have no cash value, are non-negotiable, non-transferrable, and cannot be redeemed in whole or in part for cash.
2.4 The number of Pulsebeats you have earned and the cumulative total of unredeemed Pulsebeats available at that date, as well as the number of Pulsebeats redeemed during the statement period will be shown on your monthly Programme statement. Pulsebeats may not be transferred to any other account.
3. Pulse Book
3.1 A list of reward products which are included in the Programme ("Rewards"), are described in the online catalogue ("Pulse Book"), which can be found for the UK at www.sonycard.co.uk/pulsebook and for Ireland at www.sonycard.ie/pulsebook.
3.2 The availability and number of Pulsebeats required for Rewards is subject to change without notice at any time.
3.3 Unless stated otherwise the Pulsebeats values for all Rewards shown in the Pulse Book include applicable Value Added Tax, handling, and shipping.
3.4 All Reward selections are subject to availability. If your selection is unavailable then SUKL may offer you an alternative product.
3.5 Products are supplied in accordance with SUKL's standard specifications but SUKL reserves the right to make improvements and modifications in such specifications without prior notice as it or its suppliers consider desirable in the circumstances.
3.6 Every effort is made to ensure that the Pulse Book is accurate. However, neither SUKL, nor any other Sony group companies nor its agents are responsible for any typographical or pricing errors.
3.7 SUKL may offer special promotional Rewards from time to time.
4. How To Redeem Pulsebeats
4.1 You can use Pulsebeats to claim any Reward listed in the Pulse Book. Look up the item you want and call the SonyCard Reward Redemption Centre.
4.2 In the UK, call 0870 036 2444 and in Ireland call 1850 946 907 between the hours of 9.00am - 5.30pm each weekday (excluding Bank Holidays).
4.3 When ordering you must have at least the number of Pulsebeats needed for the Reward you select. Pulsebeats cannot be accepted in part payment for any Reward unless otherwise specified. SUKL will process your order and deduct your Pulsebeats automatically.
5. Reward Availability
5.1 SUKL makes every effort to ensure that Rewards described in the Pulse Book are available. However, if after 28 days the Reward you have ordered is still not available, we will let you know by telephone or letter and cancel your order and re-credit the Pulsebeats to your account.
6. Reward Delivery
6.1 Rewards will only be shipped to your registered Programme address within the UK or Ireland. Some Rewards within a single order may be shipped separately.
6.2 Risk in Rewards shall pass to you upon delivery to your registered Programme address.
6.3. Unless you have been notified of a delay in the delivery of the Reward in accordance with clause 5.1 above, if the Reward has not been delivered within 28 days from the date of order, please call the Reward Redemption Centre within 7 days.
7. Guarantee
7.1 SUKL makes no guarantees or warranties in respect of a Reward other than (i) those stated in the guarantee card(s) accompanying the Reward; or (ii) where the Reward is shipped without a guarantee card, the minimum statutory warranty is applicable. This shall not affect your prevailing statutory rights under any applicable national law.
7.2 Any faulty and/or damaged Rewards will be dealt with in accordance with the applicable guarantee (if any) and the return conditions set out in Section 8 below.
8. Cancelling an Order
8.1 You have a right to cancel your order for a Reward from the time the order is made until 7 working days after the delivery of the Reward. Provided that :
8.1.1 For a cancellation made prior to receipt of the Reward you notify SUKL by telephone on UK: 0870 036 2444 and Ireland: 1850 946 907.
8.1.2 In the event that the Reward has already been dispatched or for a cancellation made after receipt of the Reward you comply with the all the requirements of Section 10 below and the Reward is returned with the original packaging and all accessories, and in the case of DVDs, Super Audio CDs, CDs, software, and audio or video tape products that the Reward has not been unsealed from its packaging.
9. Faulty or Damaged Rewards
9.1 All Rewards and their packaging leave our warehouse in good condition. For Rewards that appear to have been damaged in transit, for example if the outer packaging appears to be damaged, please refuse delivery and contact the Programme Helpdesk (UK: 0870 036 2444 and Ireland: 1850 946 907) within 24 hours. Do not sign the documents to say that you have received it.
9.2 In the unlikely event that you find that the Reward is faulty within 7 days of delivery you may return the faulty Reward for replacement.
9.3 For Rewards, which are faulty, within the meaning of the accompanying Sony guarantee (if any), please follow the instructions given in the relevant Sony guarantee (if any) or on the Rewards or their packaging.
10. Returning Rewards
10.1 Where you are entitled to and do return the Rewards to SUKL in accordance with these terms and conditions, SUKL will refund the Pulsebeats redeemed for the Reward in question, provided that you have obtained a SUKL Return Authorisation Number and subject to the conditions set out below.
10.1.1 You have obtained a SUKL Return Authorisation Number by telephoning UK: 0870 036 2444 and Ireland: 1850 946 907. Note: The number is valid for 14 calendar days from the date of issue.
10.1.2 The SUKL Return Authorisation Number must be prominently visible outside the parcel in which the Reward is returned to SUKL.
10.1.3 Rewards must be returned in or with their original packaging. A restocking fee may be charged for damages and missing parts.
10.1.4 You shall be responsible for (except if returning under 9.2 above) and prepay all shipping charges and shall assume all risk of loss and damage to products whilst in transit to SUKL.
10.2 If Rewards are returned to SUKL without obtaining a SUKL Return Authorisation Number, or after the valid period of such number, or without proper packaging, or with parts of the Rewards missing, or without prepaid delivery, SUKL retains the right to either refuse delivery, or charge a restocking fee and delivery charges.
10.3 Upon valid return of a Reward in accordance with this clause 10, SUKL shall credit the number of Pulsebeats redeemed for the Rewards, less any fees and charges due to SUKL, by crediting Pulsebeats to your Programme account. No cash refund will be given.
11. Expiry of Pulsebeats
11.1 Unless sub clause 9.2 applies, any Pulsebeats held on your Pulsebeats account will expire 3 years from the date on which they were credited to the Pulsebeats account. When redeeming Pulsebeats, the oldest points will be deducted first.
11.2 If SUKL terminates the Programme you will have a period of 1 year from the date of the notice of termination of the Programme to redeem all your unexpired Pulsebeats.
12. Customer Data
12.1 SUKL and other members of the Sony Group ("Sony") may use the personal data provided by you to advise of, offer and supply goods and services, and for other marketing purposes as laid out in the SUKL's Privacy Policy. Personal data will assist Sony in further improving its services. Sony may not be able to provide certain services without such data.
12.2 You agree that:
The personal data provided by you ("Personal Data") may be used by Sony e- Solutions Europe B.V. and its affiliates worldwide (together," Sony") to advise of, offer and supply goods and services, for other marketing purposes, and for added purposes described in the terms relating to your transaction.
The Personal Data will assist Sony in its efforts to further improve products and services. Without such data, Sony may be unable to provide certain services. In providing products and services, Sony may share Personal Data only with selected third parties. On your request to Sony e-Solutions Europe B.V., your Personal Data stored with Sony will be provided, corrected, amended or deleted. Sony's treatment of Personal Data will accord with the above conditions and any applicable laws.

13. Security
13.1 Whilst you are the holder of the Pulsebeats you are responsible for their security. SUKL is the owner of the Pulsebeats and they remain SUKL's property at all times.
13.2 It is your responsibility to keep secure any information that might establish your identity and enable anyone to use your Pulsebeats. SUKL cannot be held responsible if a person is able to use Pulsebeats through possession of your details.
13.3 Please make sure to keep your account address up to date and accurate to minimise security risks. SUKL cannot be responsible for mislaid post and SUKL recommend that you use recorded delivery when sending us important documentation.
14. General
14.1 You acknowledge and accept that the name "Pulsebeats" is owned by SUKL and that you have no right or interest therein.
14.2 The Programme is offered at the full discretion of SUKL who is responsible for the Programme operation and Reward fulfilment.
14.3 SUKL reserves the right to vary the Programme and these Terms and Conditions or terminate the Programme at any time.
14.4 Any waiver by SUKL of its rights under these Terms and Conditions to require compliance with any of the provisions shall not act as a continuing waiver of such rights or as a waiver of such rights in the future.
14.5 Neither SUKL nor any company involved in the operation of the Programme or an Individual Reward Scheme has any responsibility for any tax liability that you may have from collecting or redeeming Pulsebeats.
14.6 These Terms and Conditions do not affect your statutory rights.
14.7 These Terms and Conditions are subject to English law.
B _ The Pulse Reward Programme Individual Reward Scheme terms and conditions for SonyCard holders
1. The SonyCard Pulse Reward Programme
1.1 These Individual Reward Scheme terms and conditions for SonyCard holders apply in relation to the operation of the Programme in addition to the Sony Pulse Reward Programme general terms and conditions set out in section A above
1.2 The SonyCard Credit Card ("SonyCard") is issued by MBNA Europe Bank Limited. As a SonyCard holder your membership of the Programme starts when your Sony Card account is opened and ends when your Sony Card account is closed.
1.3 MBNA Europe Bank Limited is the provider of the SonyCard but has no responsibility for the provision or management of the Programme. Use of your SonyCard is governed by the Credit Agreement regulated by the Consumer Credit Act 1974 Terms and Conditions under your agreement with MBNA Europe Bank Limited.
1.4 MBNA Europe Bank Limited gives no warranties of any kind on any goods or services redeemed using Pulsebeats under the Programme.
1.5 Should you lose or accidentally disclose your account number or mislay your SonyCard contact MBNA Europe Bank Limited immediately. Please call; UK 0800 062 062 and Ireland 1800 409 511 (freephone, 24 hours a day, 365 days a year).
2. How To Earn Pulsebeats with your SonyCard
2.1 Each time you make purchases on your SonyCard you will earn 1 Pulsebeat for every full £1 in the UK ( €1.50 in Ireland) you spend. No Pulsebeats will be awarded in respect of purchase using the SonyCard for: Cash Advances, Credit Card Cheques, any Gambling transactions including Casino and Gaming Machine transaction or purchase where the accruing of Pulsebeats is otherwise prohibited by legislation.
2.2 The number of Pulsebeats you have earned will be shown on your normal monthly SonyCard statement. Foreign currency purchases will be converted to Sterling at the SonyCard prevailing rate.
2.3 You can claim 2 additional Pulsebeats for every £1 ( €1.50 in Ireland) that you spend using your SonyCard on Sony branded consumer products purchased from authorised retailers within the European Economic Area ("Triple Pulsebeats").
2.4 For the purposes of the Programme "Sony-branded consumer product" means (i) Sony-branded consumer electronics product range marketing from time to time by Sony United Kingdom Limited to the consumer market sector (ii) genuine branded videos and DVDs released from time to time by Sony Pictures Entertainment (iii) genuine music (all formats inc. Super Audio CD/CD/MD/Tape) released from time to time under the Sony BMG Music / Columbia / Epic / S2 / INCredible / Higher Ground brands and (iv) genuine PlayStation-branded games consoles, peripherals, and games marketed in the UK and ROI from time to time by Sony Computer Entertainment. Unless otherwise stated this shall exclude but not be limited to products marketed by Sony for broadcast and professional use or the products of any other Sony group not mentioned above.
2.5 In order to claim Triple Pulsebeats you must complete the Triple Pulsebeats claim form. Triple Pulsebeats claim forms may be downloaded from www.sonycard.co.uk/members in the UK and www.sonycard.co.ie/members in Ireland and can also be requested from the SUKL Redemption Centre. In the UK, call 0870 036 2444 and Ireland call 1850 946 907 between the hours of 9.00am - 5.30pm each weekday (excluding Bank Holidays). The contact numbers may be changed from time to time.
2.6 The Triple Pulsebeats claim form must be submitted with a COPY of your itemised sales receipt of the Sony item(s) purchased and credit card slip, and must be mailed to SUKL within 90 days of the purchase date, as described on the latest Triple Pulsebeats claim form. It may take a few days for your additional Pulsebeats to be included in your Pulsebeats total.
2.7 Pulsebeats will only be earned for purchases made with SonyCard unless advised separately by SUKL .
2.8 In the case of refunds, your Pulsebeats will be adjusted by deducting the number of points earned on the original purchase.
3. Circumstances in which Pulsebeats will not be earned and/or redeemed
3.1 You cannot earn or redeem any Pulsebeats while you are in breach of your SonyCard terms and conditions. So, for example, if you are late making any payment due on your SonyCard account you will be unable to earn or redeem any Pulsebeats until you have made that payment. Likewise, if you go over your credit limit you will be unable to earn or redeem any Pulsebeats until your balance is back below the credit limit.
3.2 Where SonyCard believe that there has been a breach of the Credit Agreement regulated by the Consumer Credit Act 1974 Terms and Conditions, SonyCard may withdraw Pulsebeats already awarded.
3.3 Your Pulsebeats cannot be redeemed and will be cancelled if you close your SonyCard account, or if MBNA Europe Bank Limited terminates your SonyCard Credit agreement as a result of a breach by you of a term of use of the SonyCard. If MBNA Europe Bank Limited terminates your SonyCard agreement for any other reason you will be able to redeem your unexpired SonyCard Pulsebeats for up to 1 year after notice of termination. All Pulse Catalogue information is correct at time of print (August 2005) Note: Pulse Catalogue product range and Pulsebeat values may be subject to change.
C _ Partial payment Terms and Conditions
1.1 Only those products specified in the SonyCard Rewards Brochure are available using a combination of points plus cash. No other rewards can be brought in this way.
1.2 Products that are brought using Pulsebeats & Cash must be paid for using a SonyCard. No other payment method will be accepted.
